Terms of use

TERMS AND CONDITIONS – LuxuryFlowers


Definitions

  • Order – an electronic document that acts as a communication between the Seller and the Customer, by which the Seller agrees to deliver the ordered products and the Customer agrees to receive and pay for them.

  • Courier – any employee or contracted company providing delivery services.

  • Recipient – the individual or legal entity receiving the ordered products.

  • Delivery interval – a time window selected on the website within which the delivery takes place.

  • Fixed hour – a specific hour chosen by the customer, which we are obligated to respect. This service has an additional cost that varies depending on time of day.

  • Products – any product displayed on the website and mentioned in the order, to be delivered by the Seller to the Recipient.

  • Seller/Company – LuxuryFlowers

  • Customer – the individual, legal person, or any entity placing an order.


I. GENERAL PROVISIONS

  1. Before using our website, please carefully read these Terms and Conditions. Visiting luxuryflowers.net or using (purchasing products via) the site implies full acceptance of the Terms and Conditions, which represent a contractual agreement between parties.

  2. Using the services provided by LuxuryFlowers equates to explicit agreement with these Terms. By registering or using the services, the Client confirms that they have read, understood, and accepted the Terms, and that the provider cannot be held responsible for any losses arising from not having read these Terms.

  3. By placing an order, the Client automatically accepts all the Terms and Conditions listed below, regardless of whether they have been read.

  4. The provider reserves the right to change these Terms at any time without prior notice. Clients are expected to read all Terms before placing an order to ensure they are aware of any changes. In the event of material changes, the provider will attempt to notify users at least 30 days prior to the enforcement of the new terms.

  5. Orders or price quote requests will only be accepted through the contact form on this website, via email, WhatsApp, or telephone. The Client must provide correct and specific details about the desired product. The provider is not liable for issues arising from incorrect or incomplete information provided by the Client.

  6. Delivery timeframes and contract durations are discussed on a per-order basis and included in the service agreement.

  7. All contractual provisions that are meant to survive termination (such as ownership, warranty disclaimers, overdue payments, or liability limitations) will remain effective post-contract.


II. PRODUCTS / PRICING POLICY

  1. The services provided by LuxuryFlowers are payable in full in advance, unless otherwise stated for certain custom event orders (e.g. weddings).

  2. All product images are illustrative. Variations in color, shape, size, and accessories may occur due to seasonal availability, photography lighting, screen settings, and floral stock.

  3. Floral compositions are unique. If a certain flower or accessory is unavailable, it will be replaced with another of similar value and style. Essential changes will be communicated to the Client when possible. Lack of response will be interpreted as implied agreement.

  4. Minimum order value is 89 RON.

  5. LuxuryFlowers' liability regarding claims is limited to the value paid by the Customer.

  6. Changes to the order must be communicated via phone, email or WhatsApp at least 5 hours prior to delivery. For later changes (e.g., 4 hours before delivery), the Client will be invoiced accordingly.

  7. Orders can be cancelled by phone at least 5 hours before delivery.

  8. Same-day orders are accepted until 20:00.

  9. In the event of Client breach, the Company may suspend services until the matter is resolved or terminate the agreement.

  10. Free extra services (e.g., delivery photo, SMS confirmation) are not guaranteed.

  11. Orders via the website are accepted 24/7.

  12. According to Romanian law, alcoholic products cannot be sold to minors. By accepting these Terms, the Customer declares they are over 18 if ordering such items. Orders may be canceled if this is violated.


III. PAYMENT

  1. Orders must be paid in advance via bank card (PayU), PayPal or cash on delivery. Orders are delivered only after payment confirmation.

IV. DELIVERY SERVICE IN BUCHAREST / ILFOV AND OTHER LOCALITIES

  1. Delivery terms are discussed per request and confirmed through a service agreement.

  2. We deliver flowers and gifts nationwide. Delivery costs vary by region.

  3. In Bucharest and nearby areas, deliveries take 2–5 hours after payment.

  4. In other parts of Romania, delivery takes 2–6 hours post-payment.

  5. If the Recipient's address is unknown, the Client must provide a phone number. Refusal to receive the order is considered a completed delivery.

  6. If delivery is based on a Facebook name and the person cannot be identified, the payment will be refunded. If the Recipient refuses to disclose delivery details, the order is canceled and refunded.

  7. Delivery in Bucharest and nearby areas is performed within 2–5 hours. Exact time slots can be selected on the website.

  8. Hotel deliveries are made to the reception only.

  9. Accurate delivery depends on the Client-provided Recipient details. Please complete the order form carefully.

  10. We only deliver our own products. We do not deliver third-party gifts.

  11. Delivery in Bucharest is free for floral products. Delivery for other products and other localities is chargeable. See our website for price details.

  12. If incorrect or incomplete data is provided, or the recipient is unavailable, delivery may be postponed. A repeat delivery will be charged.


V. RETURNS, COMPLAINTS AND DISPUTES

  1. Any complaints must be submitted within 24 hours of delivery. Due to the perishable nature of flowers, refunds or replacements will not be accepted after this window. If the error is on our part, we guarantee a full refund.

  2. Cancellations made within 24 hours are fully refundable. Payment processing fees will be deducted.

  3. Refund methods depend on the original payment method.

  4. Additional paid services (e.g., timed delivery) will be refunded partially in case of non-fulfillment.

  5. We comply with Romanian legislation regarding electronic commerce and consumer rights (Law 365/2002 and GEO 34/2014).

  6. Disputes will first be resolved amicably within 30 business days. If this fails, they will be settled in the courts of Bucharest.


VI. FORCE MAJEURE

  1. If a force majeure event prevents contractual obligations, performance will be suspended for the duration of the event. This applies only when fulfillment is impossible, not merely difficult.

  2. LuxuryFlowers cannot be held liable for delays or errors resulting from uncontrollable factors including, but not limited to, power outages, internet failure, natural disasters, or cyber attacks.


VII. DATA CONFIDENTIALITY AND PRIVACY POLICY

  1. LuxuryFlowers will not sell, share, or rent personal data to third parties.

  2. Please read our Privacy Policy to understand how we collect and use personal information.

  3. By using our services, the Client agrees that LuxuryFlowers may use their data in compliance with the GDPR.

  4. We process only what is necessary, including:

    • Full name

    • Address

    • Phone number

    • Email

    • Bank details

    • Login credentials

  5. Data is stored securely using technical and organizational safeguards.

  6. We may disclose information if legally required to do so.

  7. Clients have the right to:

    • Request access to their data

    • Request correction or deletion

    • Object to processing

    • Request restriction of processing

    • Withdraw consent at any time

    • File a complaint with the data authority (ANSPDCP)


FINAL CLAUSES

  1. The Client is responsible for using appropriate, legal, and respectful content in greeting card texts or any communication. No discriminatory, offensive, or illegal content is allowed.

  2. The Client is responsible for providing accurate data when placing an order.

  3. LuxuryFlowers is not liable for failure to fulfill an order due to unforeseen or uncontrollable external factors (force majeure).

  4. During major holidays (Valentine’s Day, 1st and 8th March, Easter, Christmas), we reserve the right not to provide delivery photo confirmations due to high order volume.
