Terms of use

This document sets out the terms and conditions for using the website LuxuryFlower.net, as well as the conditions applicable to orders placed through this website.

By accessing the website, placing an order, or using the services available on LuxuryFlower.net, the Client confirms that they have read, understood, and fully accepted this document.

2. Definitions

For the purposes of this document, the following terms shall have the meanings below:

  • Website – the online platform available at LuxuryFlower.net.
  • Seller / Company – OK FLORA FLOWERS SRL, the operator of LuxuryFlower.net.
  • Client / Buyer / Order Holder – the individual, legal entity, or any other entity placing an order on the website, by phone, by email, or through other channels made available by the Seller.
  • Recipient – the individual or legal entity indicated by the Client to receive the ordered products.
  • Order – the request sent by the Client to the Seller, through which the Client requests the purchase and delivery of one or more products.
  • Products – bouquets, floral arrangements, rose boxes, gifts, additional products, or any other products displayed on the website and included in the order.
  • Customized products – products individually made to order, according to the Client’s specifications or depending on the availability of flowers, accessories, and materials.
  • Perishable products – products that, by their nature, may deteriorate quickly, including flowers, plants, floral arrangements, and other natural products.
  • Courier – the employee or company contracted by the Seller to deliver the products.
  • Delivery interval – the time period selected by the Client or available on the website for delivery.
  • Fixed delivery time – the exact time or strict delivery period selected by the Client, where this service is available and paid separately.

3. General Provisions

3.1. Use of the LuxuryFlower.net website implies full acceptance of these Terms and Conditions.

3.2. By placing an order, the Client declares that they have read, understood, and accepted this document, including the delivery policy, return policy, complaints policy, and the conditions applicable to customized and perishable products.

3.3. The Seller reserves the right to modify this document without prior notice. The applicable version is the one published on the website at the time the order is placed.

3.4. The Client is required to provide correct, complete, and up-to-date information for order processing, invoicing, and delivery. The Seller cannot be held liable for delays, failed deliveries, or other inconveniences caused by incorrect or incomplete information provided by the Client.

3.5. Orders may be placed online, by phone, by email, or through other communication channels made available by the Seller.

3.6. Online ordering is available 24/7. Processing, confirmation, and delivery of orders are carried out depending on the operational schedule, product availability, and logistical conditions.

4. Products and Pricing Policy

4.1. LuxuryFlowers sells bouquets, floral arrangements, rose boxes, gifts, and additional products.

4.2. All floral products sold on LuxuryFlower.net are considered customized products, made to order, as well as perishable products.

4.3. Product photos displayed on the website are for presentation purposes only. Colors, shades, dimensions, flower opening stage, packaging, accessories, and final appearance may vary depending on the season, flower availability, stock, lighting conditions, viewing device, and the natural characteristics of flowers.

4.4. Each floral composition is individual. The final product may differ from the presentation image, but the Seller will make every effort to preserve the style, value, general color palette, and main characteristics of the ordered product.

4.5. If certain flowers, plants, accessories, vases, or materials are unavailable or do not meet quality standards, the Seller reserves the right to replace them with similar products of equal or higher value.

4.6. If the change is essential and significantly alters the appearance of the product, the Seller will attempt to contact the Client for confirmation. If the Client cannot be contacted in due time, their consent to the necessary changes shall be considered implied for the purpose of fulfilling the order.

4.7. Supporting greenery, decorative foliage, packaging, ribbons, boxes, vases, and other accessories may be replaced without prior notice, while maintaining the general characteristics of the product.

4.8. The minimum order value registered on the website is 89 RON.

4.9. Prices displayed on the website are expressed in RON and may be changed without prior notice. The applicable price is the one displayed at the time the order is placed.

4.10. The Seller’s liability in connection with an order is limited to the amount paid by the Client for that specific order.

5. Products Containing Alcohol

5.1. The website may sell products containing alcohol, including wine, champagne, prosecco, or other alcoholic beverages.

5.2. Under applicable law, alcoholic products may not be sold to minors.

5.3. By placing an order that includes alcoholic products, the Client declares that they are at least 18 years old and legally entitled to purchase such products.

5.4. The Seller reserves the right to refuse or cancel orders containing alcoholic products if there are reasonable suspicions that the legal minimum age requirement is not met.

6. Payment

6.1. Orders may be paid using the following methods:

  • online card payment;
  • Apple Pay;
  • Google Pay;
  • PayPal;
  • bank transfer;
  • cash on delivery, if this option is available for the respective order.

6.2. In general, orders must be paid in full in advance. Delivery is carried out after payment confirmation, except where the Seller expressly approves another payment method.

6.3. In the case of payment by bank transfer, the order will be processed after the amount is confirmed in the Seller’s account or after valid proof of payment is provided and accepted by the Seller.

6.4. Bank fees, payment processor fees, or differences generated by the selected payment method may be borne by the Client, depending on the case.

7. Order Changes and Cancellation

7.1. Any change to an order, including product changes, adding products, changing the greeting message, changing the address, delivery date, or delivery interval, must be communicated at least 5 hours before the scheduled delivery time.

7.2. If the change request is sent less than 5 hours before delivery, the Seller does not guarantee that the change can be applied.

7.3. An order may be cancelled only by phone or email, at least 5 hours before the scheduled delivery time.

7.4. For orders that have already been prepared, are in progress, or have been handed over to the courier, cancellation may no longer be possible, given the customized and perishable nature of the products.

7.5. Orders for same-day delivery and for the following night are accepted until 20:00, depending on product availability and operational capacity.

8. Product Delivery

8.1. LuxuryFlowers delivers flowers and gifts anywhere in Romania.

8.2. Delivery costs may vary depending on the location, product type, selected interval, and additional services requested.

8.3. In Bucharest, bouquets and floral arrangements benefit from free standard delivery within the intervals available on the website.

8.4. For additional products that do not contain flowers or floral arrangements, such as toys, balloons, sweets, drinks, or other gifts, delivery may be charged separately.

8.5. For other locations in Romania, including areas surrounding Bucharest, delivery is subject to a fee, according to the rate displayed or communicated when the order is placed.

8.6. In Bucharest and surrounding areas, delivery is generally made within 2–5 hours after payment confirmation.

8.7. In other regions of Romania, delivery is generally made within 2–6 hours after payment confirmation, depending on the location, product availability, and logistical conditions.

8.8. Delivery intervals are indicative, except where the Client has paid for a special fixed-time delivery service and this service has been confirmed by the Seller.

8.9. The Seller will make every effort to respect the delivery date and interval selected by the Client, but cannot always guarantee the exact time, especially in the case of fresh products, adverse weather conditions, traffic, high order volume, or other factors beyond the Seller’s direct control.

8.10. During busy periods, such as February 14, March 1, March 8, Easter, Christmas, or other major holidays, delays may occur, and the Seller reserves the right to modify the available delivery intervals.

9. Delivery Through Local Partners

9.1. For certain locations in Romania, the Seller may collaborate with local florists or local partners for product preparation and delivery.

9.2. If the product is prepared by a local partner, the Client accepts that the final product may not be identical to the presentation photo on the website.

9.3. Differences may occur due to seasonal flower availability, local stock, available accessories, working techniques, and regional particularities.

9.4. The Seller will inform the Client of essential changes when such changes exist and can be communicated before delivery.

9.5. After the Client accepts the changes, the Seller no longer has the obligation to provide repeat delivery, return, or refund, except where the delivered product shows obvious non-conformities, such as wilted, broken, or non-compliant flowers or auxiliary products.

10. Client Obligations Regarding Delivery

10.1. The Client is required to provide correct and complete information about the recipient and delivery address.

10.2. Required details may include: recipient’s name, phone number, full address, city, intercom code, entrance, floor, apartment, company, department, hotel room, or other details necessary for the courier.

10.3. If the Client does not know the recipient’s address, they may provide the recipient’s phone number, and the Seller may attempt to establish the delivery details directly with the recipient.

10.4. If the recipient refuses to receive the products, the delivery is considered completed, and the amount paid is not refunded.

10.5. If the recipient refuses to provide the data necessary for delivery, the Seller cannot be held responsible for the impossibility of fulfilling the order.

10.6. If the recipient is not at the indicated address, does not answer the phone, or is unavailable, the Client will be informed, and delivery may be rescheduled for an additional fee.

10.7. For repeat delivery in Bucharest, the fee is 49 RON.

10.8. For other locations, the repeat delivery fee is equal to the initial delivery fee or to the amount communicated by the Seller depending on the destination.

10.9. If the recipient cannot be found within 72 hours, even with the Client’s assistance, the order is considered completed, and the amount paid is not refunded.

11. Delivery to Hotels, Institutions, and Special Locations

11.1. For deliveries to hotels, guesthouses, campsites, institutions, offices, restaurants, or other special locations, the Client must provide all details necessary to identify the recipient.

11.2. For hotel deliveries, the Client must indicate the recipient’s full name, room number, booking name, or other relevant information.

11.3. If the location’s rules do not allow the courier to access the recipient directly, delivery to reception, security, administration, or the receiving point indicated by the location is considered completed.

11.4. The Seller is not responsible for delays or failed deliveries caused by incorrect information, the recipient’s departure, room changes, access restrictions, or the location’s refusal to receive the products.

12. Anonymous Orders and Surprise Deliveries

12.1. In the case of surprise orders, the Client accepts that the Seller may contact the recipient to confirm the address, availability, or other details necessary for delivery.

12.2. If the recipient refuses to receive the products, the delivery is considered completed, and the amount paid is not refunded.

12.3. If the recipient refuses to provide the data necessary for delivery, the Seller cannot be held responsible for the impossibility of fulfilling the order.

12.4. If delivery is requested based on a name from a social network, without a complete address and without sufficient identification data, the Seller will make reasonable efforts to identify the recipient but does not guarantee successful delivery.

13. Additional Services

13.1. The Seller may offer, depending on availability, additional services such as greeting message, proof photo, delivery confirmation, special delivery, fixed-time delivery, or other supplementary services.

13.2. Free additional services are not guaranteed. The Seller cannot be penalized for failing to provide free services such as sending a product photo, SMS confirmation, or including a free greeting card.

13.3. During busy periods, such as February 14, March 1, March 8, Easter, Christmas, or other holidays with high order volume, the Seller reserves the right not to send a proof photo.

13.4. If a paid additional service is not performed, the Client may request a refund of the value of that service, without affecting the value of the delivered products.

14. Return and Complaints Policy

14.1. Since floral products are perishable and customized products, they cannot be returned, except where the delivered product has obvious non-conformities attributable to the Seller.

14.2. Complaints regarding product quality must be submitted within a maximum of 24 hours from delivery.

14.3. Complaints must be accompanied by clear photos of the delivered product, taken on the same day or as soon as possible after delivery.

14.4. If the complaint is not submitted within the indicated period or is not accompanied by photos, the Seller reserves the right to refuse product replacement or refund.

14.5. If the product was delivered according to the order, and the differences from the presentation photo are caused by natural, seasonal, availability-related, or flower-specific factors, these differences do not constitute grounds for return or full refund.

14.6. If, after evaluating the complaint, the Seller finds that the product was non-compliant due to its fault, it may propose one of the following solutions:

  • product replacement;
  • repeat delivery;
  • partial refund;
  • full refund, if the situation justifies this measure.

14.7. For a full refund, the Seller may request the return of non-perishable products delivered, in the same condition in which they were received.

14.8. If the Client keeps the non-perishable products, the Seller may apply a partial refund limited to the value of the perishable products proven to be non-compliant at the time of delivery.

14.9. Refunds are made using the same payment method used for the purchase, where possible.

14.10. For card payments, the refund is made to the card used for payment.

14.11. The actual refund period may depend on the payment processor, bank, or payment method used.

15. Exclusion of the Right of Withdrawal

15.1. According to the legislation on distance contracts, the right of withdrawal does not apply to products made according to the Client’s specifications, customized products, or products that are liable to deteriorate or expire rapidly.

15.2. All floral products sold on LuxuryFlower.net are made to order and/or are perishable products, and therefore cannot be returned by simply exercising the right of withdrawal.

16. Limitation of Liability

16.1. The Seller’s liability for any claims related to an order is limited to the amount paid by the Client for that specific order.

16.2. The Seller is not liable for indirect damages, loss of opportunity, moral damages, delays caused by third parties, incorrect information provided by the Client, or the inability to contact the recipient.

16.3. The Seller is not liable for product deterioration after delivery if caused by improper storage, lack of water, exposure to sunlight, extreme temperatures, incorrect handling, or other actions occurring after the product has been handed over.

17. Force Majeure

17.1. The Seller cannot be held liable for failure or delay in fulfilling its obligations in cases of force majeure or events beyond its control.

17.2. Such events may include, without limitation: natural disasters, fires, floods, earthquakes, strikes, roadblocks, power outages, technical problems, internet or phone service interruptions, cyberattacks, measures imposed by authorities, movement restrictions, or other unforeseeable situations.

17.3. Obligations affected by force majeure shall be suspended for the duration of the force majeure event.

18. Confidentiality and Personal Data Protection

18.1. The Seller respects the confidentiality of Clients’ and Recipients’ personal data and processes data in accordance with applicable legislation, including the General Data Protection Regulation No. 2016/679.

18.2. Personal data may be collected and processed for the purpose of:

  • processing orders;
  • delivering products;
  • issuing fiscal documents;
  • collecting payments;
  • communicating with the Client and Recipient;
  • resolving complaints;
  • complying with legal obligations.

18.3. The personal data processed may include:

  • first and last name;
  • delivery address;
  • billing address;
  • phone number;
  • email address;
  • payment data;
  • greeting messages or other information voluntarily provided by the Client.

18.4. Personal data may be transmitted to couriers, payment processors, IT providers, accountants, public authorities, or other partners involved in fulfilling the order, only to the extent necessary.

18.5. The Seller does not sell personal data to third parties.

18.6. The Client has the right to access, rectification, deletion, restriction, objection, and data portability, in accordance with applicable legislation.

19. Client Obligations

19.1. The Client is required to provide true, correct, and complete information when placing an order.

19.2. The Client undertakes not to use the Seller’s services for illegal, fraudulent, offensive purposes, or purposes contrary to public morals.

19.3. The Client undertakes not to include vulgar, discriminatory, threatening, defamatory, or unlawful texts in greeting messages.

19.4. The Client is not entitled to use delivery services to gain access to restricted areas, influence individuals, transmit prohibited goods, or perform other illegal actions.

20. Dispute Resolution

20.1. Any disagreement between the Client and the Seller shall be resolved amicably whenever possible.

20.2. The Client may submit complaints or notices to: info@luxuryflower.net.

20.3. The Seller will review the notice and attempt to resolve it within a reasonable period, generally within a maximum of 30 business days.

20.4. If no amicable solution is reached, disputes shall be settled by the competent courts of Bucharest, in accordance with Romanian law.

21. Final Clauses

21.1. This document represents the agreement between the Client and the Seller regarding the use of the website and the placement of orders on LuxuryFlower.net.

21.2. If any clause of this document becomes null, invalid, or unenforceable, the remaining clauses shall remain valid and applicable.

21.3. This document is governed by Romanian law.
